F-Gas: Meeting new regulatory challenges
Understanding F-Gas
The F-Gas regulation aims to reduce fluorinated greenhouse gas emissions by limiting the use of certain refrigerants with high global warming potential (GWP) and encouraging the adoption of more sustainable practices and technologies. Refrigerants such as R-404A, R-410A, and other hydrofluorocarbons (HFCs) are being phased out or subject to strict restrictions.
Coming into force on March 11, 2024, the new European Regulation No. 2024/573 (F-GAS III) tightens up the measures of previous versions of F-Gas and accelerates the transition timetable.
The objective? To support the European Union's objective of reducing greenhouse gas emissions by at least 55% by 2030 - compared with 1990 levels - and the goal of carbon neutrality by 2050.

What is the PED regulation and in-service monitoring of ESPs?
The PED regulation (Pressure Equipment Directive) refers to Directive 2014/68/EU, which establishes the normative and regulatory requirements for the design, manufacture, and placing on the market of pressure equipment in the European Union.
It aims to ensure that such equipment presents no danger to people, property or the environment. In France, a national decree then provides a framework for in-service monitoring of pressure equipment: the ministerial decree of November 20, 2017, supplemented by the Cahier Technique Professionnel (CTP).
It imposes several obligations on operators, including the creation of the operating file, the initial inspection, the drafting of an inspection plan, inspections and periodic requalifications. In the event of non-compliance, you may be exposed to penalties (fines, daily penalty payments, shutdown of the facility, etc.).

What are ICPE regulations?
Installations Classées pour la Protection de l'Environnement (ICPE) are industrial or agricultural facilities whose activities are likely to present risks to the environment and human health. Depending on the extent of the risks and inconveniences they may generate, facilities are subject to either declaration, registration or authorization by the relevant authorities.
Establishments equipped with refrigeration facilities may be classified as ICPE when these facilities use large quantities of refrigerants such as fluorinated greenhouse gases (heading 1185) or ammonia (heading 4735).

What are the tertiary decree and the decree of July 28, 2020?
In the face of climate challenges, European Directive 2018/844 sets out the broad outlines of the energy transition in the building sector, reinforcing energy efficiency requirements. In France, the tertiary decree, which comes into force in 2019, requires tertiary buildings to achieve substantial energy savings.
To accompany this energy transition and guarantee the performance of installations, the decree of July 28, 2020 introduced a periodic inspection requirement for thermodynamic systems and ventilation systems combined with heating with a power rating of over 70 kW. Cold rooms, refrigerated warehouses and other production workshops must undergo periodic inspections carried out by COFRAC-accredited professionals.
These inspections ensure that equipment is operating optimally and complying with current regulatory requirements. By detecting any anomalies and proposing corrective measures, inspections help to reduce the energy consumption of buildings.
